Terms of Service

1. Acceptance of Terms

By creating an account or using SpeakVietnam (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

The Service is operated by SpeakVietnam, located at Trung Kinh St, Yen Hoa, Hanoi, Vietnam. Contact: hello@speakvietnam.com.

2. The Service

SpeakVietnam is an online Vietnamese language-learning platform. We provide structured lessons, vocabulary drills, pronunciation coaching powered by AI, and progress tracking. Some features require a paid subscription.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

3. Accounts

• You must be at least 13 years old to create an account. By registering, you confirm you meet this requirement.
• You are responsible for maintaining the security of your account. Sign-in is handled via your identity provider; ensure your account credentials are secure.
• You may not share your account or transfer it to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Tier and Subscriptions

The first two lessons are available free of charge. Additional lessons require an active paid subscription ("Premium").

• Billing — subscriptions are billed in advance on a recurring basis (monthly or annual) via our payment providers. All prices include applicable taxes unless stated otherwise.
• Cancellation — you may cancel your subscription at any time. Access continues until the end of the current billing period; no partial refunds are issued for unused days.
• Refunds — refund requests within 7 days of the initial purchase may be granted at our discretion if you have not completed more than two paid lessons. Contact hello@speakvietnam.com.
• Price changes — we will give at least 30 days' notice before increasing subscription prices.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations.
• Attempt to reverse-engineer, scrape, or automate access to the Service.
• Circumvent any access controls or share premium content outside your account.
• Upload or transmit malware, spam, or harmful content.
• Impersonate SpeakVietnam or any other person or entity.
• Interfere with or disrupt the integrity or performance of the Service.

6. Intellectual Property

All content on the Service — including lesson text, audio, images, and software — is owned by or licensed to SpeakVietnam and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

You retain ownership of any original content you submit (e.g. voice recordings used for pronunciation scoring). By submitting such content, you grant us a limited, non-exclusive licence to process it solely for delivering the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or that any specific learning outcomes will be achieved through use of the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SpeakVietnam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes shall first be resolved through good-faith negotiation; if unresolved, they shall be subject to the exclusive jurisdiction of the competent courts in Hanoi, Vietnam.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the site or by email. Continued use of the Service after the effective date of the revised Terms constitutes acceptance.
